INBEGRIFF FRESH SEMEN CONTRACT
This contract is made by and between the ULTIMATE
PIAFFE and _______________________________________________________________________
(Purchaser)
is for breeding of the mare named

and the stallion INBEGRIFF, 33-90191-93, for the 2007
Breeding season.

THIS SERVICE IS SUBJECT TO THE FOLLOWING CONDITIONS:
1. The determination of the mare's condition for breeding is the
purchasers responsibility.
2. A non-refundable Booking Fee of $500 is due at the signing of the
contract.
3. The 2007 Breeding Fee is $500.00. A 10% discount applies if
booked by 2/28/07.
4. The Ultimate Piaffe will collect semen for the mare one time
without a collection charge.
5. After the initial semen collection, it is the purchasers
responsibility, if additional semen collections are necessary, to
pay the collection fee of $190.
6. The cost of shipping the semen is the purchasers responsibility.
A $100 shipping deposit will be required and applied to shipping
charges. Balance will be refunded after the completed veterinary
certificate is returned by November 30, 2007.
7. If the semen is shipped from airport to airport, there will be a
$65 charge for the transportation to the airport.
8.One breeding dose of semen will be sent in one shipment.
If available and requested, two breeding doses will be sent..
9. If an Ultimate Piaffe container is used for shipment of semen,
there is a $100 deposit required. After receipt and use of semen,
the container must be shipped back to the Ultimate Piaffe within
three (3) days. After 3 days, there will be a late container fee of
$10.00 per day. The container must be returned clean. If ballast
bags and coolant cans are damaged or missing, purchaser will be
charged. Deposit will be refunded after the completed veterinary
certificate is returned by November 30, 2007.
10. Interest of 1.5% per month will be charged on outstanding
balances.
11. The purchaser is responsible for teasing, calculating estrus and
insemination of the mare.
12. It is the purchasers responsibility to contact the Ultimate
Piaffe immediately when the mare comes into heat. The Ultimate
Piaffe will not guarantee that a collection will be made without 36
hours notice.
13. Further, it is agreed if the mare fails to conceive during the
2007 breeding season, the Ultimate Piaffe will collect and ship
again in the 2008 and 2009 season if necessary. A veterinary
certificate to that effect is required. It will be the purchasers
responsibility to pay the collection and shipping charges. If the
mare, after being checked in foal aborts or does not produce a foal
to stand and nurse, a return privilege will be granted for the 2008
and 2009 season, if necessary, without additional stud fee but the
purchaser will be responsible for collection and shipping charges. A
veterinary certificate is required within ten (10) days from the
date of death. This constitutes a 3 year live foal guarantee.
Balance of deposits are returned. Upon notification, a
substitute mare may be used during the contract period.
14. If the stallion should die before serving the mare, frozen
semen, if available, will replace fresh cooled semen. If the
named mare dies or becomes unfit to be bred before the first
shipment of semen is sent, a mare may be substituted or the fees
paid, less expenses incurred, will be returned. A veterinary
certificate will be required.
15. This agreement shall be interpreted, construed and governed by
the laws of the State of Oregon. I agree that if it is necessary for
either party to file a lawsuit arising out of this agreement, they
will only file the lawsuit in Clackamas County. If any legal action
is necessary to enforce the terms of this contract, the prevailing
party shall be entitled to reasonable attorney's fees and collection
costs.
16. When the Ultimate Piaffe, by its authorized representative,
signs and returns one copy of this contract, it will be a binding
contract on both parties subject to the above terms and conditions
and not transferable or assignable.
